You agree to indemnify Unique Topiary and hold it harmless against liabilities and expenses arising from your use of this website in the matters of claims, losses, damages suits, judgements and costs incurred in any nature by you or third parties associated with you.
Unique Topiary has taken care and precautions to ensure its website information is accurate. We accept no responsibility however for the accuracy of the website content or statements contained therein regarding our services. Further all our services are provided without a warranty save those warranties provided by law.
Unique Topiary holds the copyright to the content of this website including all uploaded files, layout design, data, graphics, articles and all components of the total website. You must not use or replicate our copyright material other than permitted by law. The trademarks and logos contained on the website are trademarks of Unique Topiary and use of these trademarks is strictly prohibited.
These Terms and Conditions are governed in accordance with the laws of Tasmania, Australia and any disputes concerning this website are to be resolved by the courts having jurisdiction in Tasmania. We retain the right to bring proceedings against you for breach of the Terms and Conditions, in your country of residence or any other appropriate country or jurisdiction.

Definitions:
Unique Topiary: This is the dealer from whom you are purchasing.
Customer: The person or company purchasing a product or service from Unique Topiary
By purchasing from Unique Topiary, you are acknowledging that you have read, understood, and agree to be bound by our terms and conditions as set out below.
Privacy Policy:
All information submitted to us is private and confidential and not shared with any third party. Unless we’re presented with a court order, your information will not be released or sold to any other person. Full privacy policy is available here
Payment Methods:
Unique Topiary accepts Direct Deposit, Paypal, *Credit Card ** (for online purchases) to pay for goods or services. Orders paid for by Direct Deposit, Paypal or Credit Card will not be processed or shipped until the funds transfer has been fully verified.
Pricing Policy:
Prices are set at the time of purchase and are subject to change without any notice. We reserve the right to not honour typographical errors on prices.
Acceptance of orders:
Unique Topiary reserves the right to refuse or cancel an order at any time, for any reason. Additionally, an automated electronic order confirmation does not indicate order acceptance.
Limitation of Liability:
All products sold are to be used at your own risk. Under no circumstances is Unique Topiary liable for third party claims against you for damages, loss of, or damage to property, economic consequential damages (including lost profits, lost data, or lost savings), or any consequential damages. Consequential damages is defined as any damage which is a consequence of using this product or our website (data loss; hardware loss; or economic losses like profit loss, customer loss, or time loss).
Unique Topiary liability is limited to the cost of the product or service purchased from us. All products we sell are to be used at your own risk and we are in no way liable for any loss, damage or injuries suffered from poor installation or use. Once shipped, goods become the responsibility of the customer who then has consumer rights to the goods being delivered by the carrier.
Damage in transit/Shortages:
Please inspect the contents of your shipment carefully upon your receipt of it. You have three (3) days after confirmed delivery to report any shortages in the shipment. We will not accept any responsibility or offer any options after those three days have passed.
Returns:
- Topiary frames or kits which include postage are clearly marked so. Shipping normally takes between 3 – 7 days depending on your location.
- Large frames or kits do not include shipping. Please contact us prior to ordering and we can give you a shipping quote, based on the weight and your location.
- We currently do not ship to international destinations.
- Please use the Contact page to enquire about further shipping requirements.
Customers can return non-defective products for a full refund, provided the item is back at Unique Topiary within 7 days. This is conditional on that the product is returned in “as new” condition, in its original undamaged packaging, and unopened if sealed by the manufacturer. Shipping charges are not refundable. Refund amounts will be based on the currently listed price on our website, or the invoice – whichever is lower. Special order items, will only be refunded after the manufacturer or distributor has approved the item for return.
The customer is solely responsible for shipping any returned product back to Unique Topiary. Customers must ship the item back to Unique Topiary using a reputable carrier that is capable of providing proof of delivery and insurance for the entire value of the shipment. The customer bears all cost of shipping charges and all risk of loss in transit to Unique Topiary. The customer agrees that the returned product will be 100% complete, in re-saleable condition, and will be complete with original packaging, manuals, etc. If any of the listed requirements are not fulfilled, Unique Topiary reserve the right to reject the refund.
